CONDITIONS OF SALE DISTANCE SELLING CONTRACT
(prepared in accordance with Legislative Decree No. 21 of February 21, 2014)

Foreword
This contract is entered into between Cantina del Dolcetto di Dogliani Sac – Via Torino 58, 12063 Dogliani (CN) (hereinafter: “Cantina del Dolcetto”) – and the final consumer (hereinafter: “Customer”) and is configured as a distance contract. It is governed by Legislative Decree Feb. 21, 2014, no. 21, implementing Directive 2011/83/EU on consumer rights and covers the buying and selling of movable goods (wine, food and gifts).
By this contract the Dolcetto Winery transfers or undertakes to transfer the ownership of said goods to the Customer and the Customer pays or undertakes to pay the price thereof.
The purchase of goods can be made through the following ways:

Purchasable goods are presented on the Internet site, in printed or electronic catalogs, by e-mail, by paper mail, by telephone, by television channel. It should be noted that the Dolcetto Winery intends to serve only the final consumer, for whom all products for sale are intended.
VAT-registered individuals who wish to receive an invoice must make a request, giving references, when placing the order, also indicating the SDI or Pec code for the issuance of electronic invoicing.

How to order – contract of sale

The Customer must fill out the order voucher (form) that appears on the screen and represents his/her shopping cart, the contents of which can be changed by the Customer at his/her discretion. You can correct errors by accessing the shopping cart, before the final step that concludes the order. After selecting the products, the Customer will see the contents of the shopping cart and the amount to be paid, with the possibility of updating and/or changing it.

In case of a request for Invoice, it is necessary to fill in the “additional information” form with the necessary information for invoicing (if requested by the customer).

Then, the Customer will proceed, by clicking on appropriate button, to go through the compilation to payment and delivery. Finally, the shopping cart and the corresponding amount to be paid will be replayed. The contract of sale will be considered finalized only when the Customer has accepted the terms and conditions of the contract by clicking on the “Order and Pay” button. If the Customer does not agree to the terms of sale and/or does not proceed to confirm acceptance of the contract by selecting the “Order and Pay” button, the contract of sale will not be concluded and the Customer will not be able to receive the executed order. In this case, Cantina del Dolcetto will not send the products in the cart nor will it charge the Customer the amount resulting from the summary of its cart. The Customer will, however, receive an e-mail from Cantina del Dolcetto confirming that the order has been taken care of, sent to the e-mail address provided by the Customer when the order was composed.

2. Mail
   The Customer can order by writing an email to the active contacts of the Dolcetto Winery, to which he/she will receive a reply during office hours. In addition to the identification data of the Customer and the person, if any, to whom the collection is delegated, he/she must indicate the descriptive list and format of the products he/she intends to purchase, the payment instrument among those accepted for the purchase, and other administrative elements useful for billing and delivery. The contract of sale will be considered finalized through the response by email from the operator by sending the Order Confirmation, after payment will be executed through the delivery of products ordered.

3. Telephone order
   The Customer may order by telephone at the numbers indicated in the active contacts for any orders for products in the printed or electronic catalogs, valid on the date of the call. The Customer will choose the products in their nature and quantity, and before the final overall order is placed, the operator will summarize to the Customer the composition of the order. To finalize the contract, through its telephone operator, Dolcetto Winery will confirm the offer to the Customer. The Customer may receive confirmation by e-mail if requested, which can be consulted at any time by the Customer. The Customer who signs the contract, will be bound to the payment and Cantina del Dolcetto can send him the ordered goods. Dolcetto Winery will provide the Customer with confirmation of the concluded contract on a durable medium within a reasonable time after the conclusion of the distance contract and at the latest at the time of delivery of the goods.

By adhering to the General Terms and Conditions, you represent that you are at least 18 years old and have the capacity to act.

Product descriptions, features and prices
The characteristics, description of the products for sale are indicated in the printed and electronic (online) catalogs next to the individual product or, in the case of the Internet site, also through appropriate link.

Prices of goods are presented on printed promotional materials and on the website, including VAT and any other taxes. The duration of promotions and offers is indicated under the product or offer to which it refers, as well as the prices charged.
Any incidental charges, where applicable, are marked against the product to which they apply.
The replacement of an out-of-stock item within a package will be made with an alternative item of the same value after notifying the customer.

Shipping costs
A
contribution to shipping costs
for each order delivered within the Italian territory to the same recipient, calculated according to the quantities ordered. For website orders, the amount is always indicated and visible at the time of the purchase process.
For telephone orders, the amount of the delivery charge contribution is repeated by telephone.
For bulky packages or for particular value of the goods
transported may be required to pay a
packing fee
, the amount of which varies from the product to be delivered and, in any case, is transparently indicated in the documentation – paper or electronic – that allows the order to be finalized.

Accepted payment instruments

Accepted are.
: (i) CartaSì, MasterCard, American Express, Visa credit card; (ii) marking (iii) PayPal (iv) Satispay or, subject to the authorization of Cantina del Dolcetto through bank transfer, in the latter case the Customer is required to provide a copy of the accounting and/or notice of having made the payment.
It should be noted that the Dolcetto Winery will not impose fees on Customers in connection with the aforementioned payment cards, or in the cases expressly established, fees that exceed those incurred by the Dolcetto Winery itself. The payment card issuer shall re-credit the Customer for payments in the event of overcharging in excess of the agreed price or in the event of fraudulent use of their payment card by Dolcetto Winery or a third party. The payment card issuer has the right to charge the Dolcetto Winery for the amounts credited back to the Customer.

Delivery terms and liability
Dolcetto Winery, in compliance with Art. 61, d. lgs 21/2014, undertakes to deliver the ordered goods. Delivery is considered to have been made when the goods ordered enter the possession of the Customer or the person whom the Customer has delegated to collect them. In the event that these terms cannot be met (e.g.: products not in stock), the Winery undertakes to notify the Customer through the mode that allows the most timely manner to warn him and indicate when the goods can be delivered.
Although Art. 63, d. lgs 21/2014 establishes that if the products suffer loss or damage, due to causes not attributable to Cantina del Dolcetto, the resulting risk is transferred to the Customer only at the moment when the latter, or a third party designated by him and other than the carrier, materially takes possession of the goods, thea Cantina del Dolcetto guarantees the replacement of damaged products at no charge to the Customer, only if the goods have been accepted subject to control and with note of the damage at the time of delivery.

Telephone expenses
Cantina del Dolcetto does not charge any fee for contacting us by telephone to get information about the ‘order, the Customer is required to pay the rate provided by their telephone provider.

Unsolicited supplies
Unless the Customer consents, to be expressed before or at the time of the conclusion of the contract, Dolcetto Winery will not make any supply other than that agreed upon, even if of equivalent or superior value and quality.
Should the Customer receive an unsolicited supply, he/she shall give
notice to Cantina del Dolcetto di Dogliani Customer Service, Via Torino 58, 12063 Dogliani (CN)
, so that Cantina del Dolcetto can arrange for the withdrawal of said supply.

Right of withdrawal
Although Art. 52, d. lgs 21/2014 allow the Customer to exercise the right of withdrawal (i.e. the right to return the goods, for any reason whatsoever and without giving any justification and without any charge to him) after n. Fourteen (14) days after delivery of the goods, Dolcetto Winery grants the Customer the widest term of n. Thirty (30) days from the delivery of the goods. Therefore, the Customer may exercise the right of withdrawal within no. 30 (thirty) days after taking possession of the ordered goods, at no charge to him, simply by giving notice to Cantina del Dolcetto. The right of withdrawal can be exercised in the following ways:

1. submit any explicit statement of your decision to withdraw from the contract, via e-mail (info@cantinadolcettodogliani.it);
2. via regular mail (Cantina del Dolcetto di Dogliani SaC, Via Torino 58- 12063 Dogliani (CN));

Upon receipt of the withdrawal request,
Dolcetto Winery will collect the goods from the Customer.

To report any anomalies or mishaps or receive assistance on products that do not conform to the order, the Customer may contact Cantina del Dolcetto Customer Service at the above contact details.
In the case of withdrawal, the obligations on the part of the Dolcetto Winery and the Customer lapse. In particular, Dolcetto Winery will reimburse the Customer for the cost of the products ordered, including delivery charges, within no. Fourteen (14) days after the right of withdrawal has been exercised and the goods have returned to the possession of Cantina del Dolcetto. Dolcetto Winery will reimburse the Customer with the same instrument used by the Customer to pay for the order, except as otherwise agreed between the parties.

Legal warranty
Items and accessories that may accompany the offerings are guaranteed to n. 2 (two) years for any defect in manufacture or operation. Damage due to wear and tear, misuse, or improper maintenance is excluded from warranty.
The legal guarantee of conformity protects the Customer in case of purchase of defective products, which malfunction or do not respond to the use declared by Cantina del Dolcetto or for which that good is generally intended. The Customer may enforce its rights under the legal warranty of conformity by contacting the manufacturer of the goods directly.

In the presence of a conformity defect, the Customer has the right, at his or her option, to repair or replacement of the defective good, without charge, unless the remedy requested is impossible or excessively burdensome compared to the other. If replacement or repair is not possible, the Customer is still entitled to a price reduction or to have back an amount, commensurate with the value of the good, against the return to Cantina del Dolcetto of the defective product. The legal warranty lasts n. 2 (two) years from the delivery of the good and must be enforced by the Customer within no. 2 (two) months from the discovery of the defect.

Jurisdiction
For any civil dispute between Cantina del Dolcetto and the Customer dependent on the regulatory interpretation and conditions presented herein, the mandatory territorial jurisdiction is of the Judge of the place of residence or domicile of Cantina del Dolcetto.
